1. Provider and scope

88 Click Shield is provided by 88Lab-2024 EOOD, UIC 207811865, VAT registered under No. BG207811865, with registered office and management address: Bulgaria, Sofia 1324, Lyulin District, Lyulin residential area, 13 Ivan Boychev St., entrance 1, floor 5, apartment 15, represented by its managing director Evgeniy Dimitrov Dimitrov, referred to below as the “Provider”.

These terms govern registration, subscription and use of the web-based service for collecting and analysing technical and behavioural data related to visits to the customer’s website.

2. Nature of the service

The platform collects data through the supplied JavaScript code and produces AI scores, summaries and recommendations for monitoring or blocking IP addresses and pre-calculated network ranges.

AI scores are decision-support tools. They do not guarantee that a visit is fraudulent and do not constitute legal, accounting or advertising advice. The customer remains responsible for the final decision whether and how to apply a recommendation, including the risk of blocking legitimate visitors.

Unless a separate integration has been explicitly enabled, adding a target to the local blocking list does not automatically add it to Google Ads, Meta, Cloudflare, a hosting firewall or another external system.

3. Account and authorised website

The customer must provide accurate contact details and protect their login credentials. The standard plan includes one user account and one linked website unless otherwise agreed. The account may not be used for a third-party website without the necessary rights or permission.

The Provider may temporarily restrict access where there is suspected misuse, a security breach, an unpaid subscription or a violation of these terms, and will notify the customer where reasonably possible.

4. Installation and customer obligations

The customer is responsible for installing the code correctly, operating their website lawfully and giving visitors the required information about tracking, including through a privacy policy and, where applicable, a consent mechanism.

The service may not be used for unlawful surveillance, personal identification, circumvention of security measures, discrimination, malicious activity or processing for which the customer has no lawful basis.

5. Trial period, price and payment

The current price, billing period and trial duration are displayed before registration. Where a trial is enabled, billing begins after the trial ends unless the subscription is cancelled in time.

Payments are processed by Stripe. The customer authorises recurring charges according to the selected plan. 88 Click Shield does not store payment-card details. Invoices, payment methods and cancellation may be managed through Stripe Customer Portal where the portal is enabled.

A change to the price or another material term applies to a future billing period after prior notice, unless applicable law permits otherwise.

6. Cancellation and access

The customer may request cancellation through Stripe Customer Portal or by contacting the Provider. Where Stripe is configured to cancel at the end of the period, access remains available until the end of the already paid period.

After cancellation, the Provider may retain data for a limited period for accounting, legal, security and backup purposes, after which it will be deleted or anonymised in accordance with the applicable privacy policy.

7. Pre-contract information and consumers

The service is intended primarily for businesses and professional users. Where the customer is a consumer under the Bulgarian Consumer Protection Act, the principal characteristics of the service, Provider details, total price and billing period, payment method, duration and cancellation terms, functionality and applicable technical requirements are provided before the order in Bulgarian.

The button that completes a paid subscription must clearly state that the order creates an obligation to pay. The landing-page price must clearly state whether VAT is included according to the Provider’s applicable tax status.

8. Withdrawal, start of service and complaints

Where the law grants a 14-day right to withdraw from a distance contract, it may be exercised by an unambiguous statement to the Provider. If the consumer expressly requests that the digital service begin before the withdrawal period expires, the consequences and any proportionate amount due are determined by mandatory law. Registration alone does not constitute a waiver of a statutory right.

Complaints should be sent to the published contact email and include a description of the issue, the account concerned and relevant evidence. The Provider responds within the applicable statutory period. Consumers may also seek assistance from the Bulgarian Consumer Protection Commission and the relevant conciliation bodies.

9. Availability, changes and maintenance

The Provider uses reasonable efforts to maintain availability and security but does not guarantee uninterrupted operation. Interruptions may occur because of maintenance, updates, external APIs, hosting, internet connectivity or force majeure.

Features may be improved or changed, provided that a material part of an already paid service is not removed without an appropriate remedy for the customer.

10. Intellectual property

The software, interface, algorithms, text and visual elements are protected. The customer receives a limited, non-exclusive and non-transferable right to use the service for the authorised website during the active subscription period.

11. Liability

The Provider is not liable for missed advertising results, decisions of advertising platforms, actions of third parties or losses caused by incorrectly installed code, inaccurate data or action taken solely on an AI recommendation without human review.

Nothing in these terms excludes liability that cannot be limited under applicable Bulgarian law. For business customers and to the extent permitted by law, aggregate contractual liability is limited to the amounts paid for the service during the preceding 12 months.

12. Personal data and privacy

Data processing is described in the Privacy policy. The customer must ensure a valid lawful basis for data sent from their website and must inform its visitors.

13. Changes to the terms

The Provider may update these terms following legal, technical or product changes. The new version is published with a version number and date. Active customers will be notified appropriately of material changes.

14. Governing law and disputes

The laws of the Republic of Bulgaria apply. The parties will first seek an amicable solution. Where the customer is a consumer, jurisdiction and out-of-court mechanisms are determined by mandatory consumer-protection rules. Disputes with business customers are heard by the competent Bulgarian court.
